Times are changing, people often get married later in life and this usually means that assets have been acquired by one person or both parties which they may consider would be unfair to split should the worst happen and the marriage subsequently breaks down.
Even if this is not the case, it is sometimes nice to agree what should happen in the event that the marriage doesn't work - it is not unromantic - just sensible. The court now accepts that pre-nups made in the correct circumstances should carry significant weight upon a marriage breakdown. Although technically under the English Law they are not legally binding the court is awarding them greater weight and it would seem that a change in the law in this respect is inevitable.
